KATHMANDU, Feb. 23 (Xinhua) -- The Supreme Court in Nepal on Tuesday overturned the decision of President Bidya Devi Bhandari to dissolve the House of Representatives on the recommendation of Prime Minister K.P. Sharma Oli on Dec. 20 last year.
The five-member Constitutional Bench of the court led by Chief Justice Cholendra Shamsher Rana announced after two months of hearing issued a mandamus order against the dissolution, saying there is no constitutional ground to dissolve the House of Representatives.
As many as 13 writs were filed against the dissolution arguing that Bhandari and Oli didn't have constitutional authority for the dissolution.
The Supreme Court has said the House is dissolved as per Article 76 (7) of the Constitution of Nepal when there is a hung parliament and there is no possibility of the formation of other governments. However, Oli recommended the dissolution when there was a possibility for the formation of other governments.
"The House of Representatives was dissolved when there were possibilities for the formation of other governments," reads the verdict read by Rana.
The House meeting must be called by March 8, according to the verdict. Enditem
